Counsel
Khushnum is Counsel and has been with the Firm since 1998. She has been involved in corporate and commercial matters, including project finance (syndicated loans, project finance, Islamic financing), establishing branches in Pakistan of foreign companies, banking and financing transactions and has assisted senior counsel in litigation in specialised tribunals and the courts in Pakistan and also on matters pertaining to mergers and acquisitions, finance and taxation, and foreign direct investment.
Khushnum primarily now advises on intellectual property matters, with a particular focus on the preparation, processing and prosecuting of applications, oppositions, infringements, opposition proceedings, appeals, and other related matters including copyrights and domain names. Khushnum has also advised extensively on trademark availability, infringement, competition commission issues, customs trademark related issues and other related intellectual property matters.
Intellectual Property
• Lead teams dedicated to maintain, protect and enforce Intellectual Property rights of clients belonging to sectors as diverse as food and beverages, cosmetics, pharmaceuticals, tobacco, and the banking industry, with extensive Intellectual Property portfolios.
• Advised clients on filing strategies with the aim to secure maximum protection at the minimum possible costs.
• Advised clients in relation to branding and marketing of brands and artworks keeping in mind the Pakistani culture and traditions.
• Advised and drafted agreements on licensing and assignment of various rights including trademarks and copyrights.
Corporate Matters
• Advised a consortium of local banks in relation to short term financing provided to K-Electric Limited.
• Advised a consortium of local banks on transfer of shares in relation to Liberty Power Tech Limited.
• Advised a consortium of local banks on release of security in relation to Liberty Power Tech Limited.
• Advised clients on Succession Matters
Litigation Matters
• Filed and pursued oppositions, rectification and invalidation actions before the Trade Marks Registry and Copyright Office, Pakistan.
• Advised clients in relation to Intellectual Property litigation matters, including filing, preparing and pursuing civil actions for Intellectual Property infringement, passing off and unfair competition and exploring settlement options and represented clients before the Intellectual Property Tribunals and Courts.
• Advised clients on the enforcement of domain names either through civil actions or through administrative proceedings under the Uniform Dispute Resolution Policy.
• Advised client and Appeared Before the Drug Regulatory Authority of Pakistan (DRAP) in a trademark-related case.
• Advised and filed documents in relation to an appeal filed before the Copyright Board relating to a trademark issue.
