After graduating from the Hamdard School of Law in 2005, Shoaib joined the firm in January 2006 and has since then been primarily involved in various matters including intellectual property, family, corporate, real estate etc. In addition to the aforesaid, Shoaib has extensive experience in matters such as incorporation of companies in Pakistan and establishing branches in Pakistan of foreign companies. Shoaib’s legal practice concentrates on handling litigious matters and has represented individuals as well as local and multinational companies before tribunals, District Courts and the High Courts located all over Pakistan, in matters ranging from commercial and civil disputes to family settlements and intestate and testamentary proceedings. He is enrolled as an advocate with the Sindh Bar Council and is a member of the Karachi Bar Association, Sindh High Court Bar Association and also a member of Pakistan Industrial & Intellectual Property Rights Association (PIPRA). He is also a member and presently the International Vice President of the Asian Patent Attorneys Association (APAA) and a member of International Trademarks Association (INTA) (based on firm’s membership) and also a member of Inter-Pacific Bar Association (IPBA).
Apart from the above, Shoaib has authored various articles for International Law Office (“ILO”) providing updates on Intellectual Property.
Advised clients on filing strategies; with the aim to secure maximum protection for clients at the minimum possible costs;
Advised clients in relation to branding and marketing of brands and artworks, particularly, in the context of the peculiarities of the Pakistani markets;
Filed and pursued oppositions, rectification and invalidation actions before the Trade Marks Registry and Copyright Office, Pakistan;
Advised clients in relation to IP litigation matters, including, in particular, filing, preparing and pursuing civil actions for IP infringement, passing off and unfair competition and exploring settlement options and represented clients before the IP Tribunals and Courts and has been successful in securing ad interim ex part injunctions.
Counseled clients with regard to border control measures and initiated and pursued enforcement actions before Customs Authorities;
Advised and drafted commercial documents, including, without limitation, agreements on licensing and assignment of various rights including trade secret, trademark, copyright and “know-how”.
Corporate and Commercial
Advised, drafted and negotiated commercial contracts, including, without limitation, license agreements, work for hire agreements, production agreements, royalty agreements and distribution agreements;
Advised clients on laws governing and regulating media and laws ancillary thereto, including, without limitation, laws with regard to advertisements and content (hate speech); and
Advised on local compliance, including with the Securities and Exchange Commission of Pakistan and the Competition Commission of Pakistan.
